Terms of Service

These Terms of Service govern your use of the Dead Hand platform ("Service"). By creating an account or using the Service, you agree to these terms. If you do not agree, do not use the Service.

The Service

Dead Hand provides an automatic response system for owner-operated service businesses. The Service captures inbound calls and voicemails, uses AI to triage and summarize them, and enables you to respond to leads via SMS from a centralized dashboard. Dead Hand does not answer calls on your behalf and does not communicate with your customers without your review and approval of each outbound message.

Eligibility

You must be at least 18 years old and operating a legitimate business to use the Service. By using the Service, you represent that you have the authority to bind your business to these terms and that all information you provide is accurate.

Account Responsibilities

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized access at [email protected].

Acceptable Use

You agree to use the Service only for lawful business communication purposes. You may not use the Service to:

• Send unsolicited SMS messages or contact individuals who have not initiated contact with your business
• Send spam, phishing, or fraudulent messages of any kind
• Violate any applicable law including TCPA, CAN-SPAM, or state consumer protection statutes
• Transmit content that is abusive, threatening, or harassing
• Circumvent the platform's opt-out handling or suppression systems
• Misrepresent your business identity or purpose in any communication
• Attempt to gain unauthorized access to other tenants' data or platform infrastructure

Violation of these terms may result in immediate account suspension without refund.

SMS and Telephone Communications

You are solely responsible for ensuring that all SMS communications sent through the Service comply with applicable law, including the Telephone Consumer Protection Act (TCPA). By using the SMS features of the Service, you represent that:

• You have obtained appropriate consent from recipients prior to sending any automated or marketing messages
• You will honor all STOP and opt-out requests immediately
• All messages accurately identify your business
• You will not use the Service to send messages to individuals on Do Not Call lists for marketing purposes

Dead Hand provides technical infrastructure for SMS communication. You, the tenant, are responsible for the legality of your communications. We are not liable for TCPA violations or other regulatory penalties arising from your use of the platform.

AI-Generated Content

The Service uses artificial intelligence to generate voicemail summaries and SMS reply drafts. These are suggestions only. You are responsible for reviewing and approving all outbound communications before they are sent. Dead Hand is not responsible for the accuracy of AI-generated summaries or the appropriateness of suggested replies.

Nature of the Service — What Dead Hand Does and Does Not Do

Dead Hand is a lead capture and response tool. It captures inbound contacts, ranks them by urgency, and prepares information and draft responses for your review. The Service performs this function automatically and consistently, regardless of the time of day or your availability.

Dead Hand does not conduct your business, book your jobs, close your sales, or ensure that captured leads result in revenue. The outcome of any lead depends entirely on your engagement with the platform and your follow-through with the customer. A lead captured and ranked by Dead Hand that goes unreviewed, unresponded to, or mishandled is the sole responsibility of the account holder.

Dead Hand is not responsible for lost business, lost revenue, or failed customer relationships that result from:

• Failure to review notifications or log into the platform in a timely manner
• Failure to respond to leads captured and surfaced by the Service
• Delayed, inappropriate, or no follow-through after an AI-suggested reply is sent
• Inaccurate or incomplete voicemails left by callers
• Caller behavior, caller expectations, or caller decisions to hire a competitor
• Business practices, pricing, availability, or service quality on the part of the account holder
• Technical issues originating outside the Dead Hand platform, including carrier delays, device failures, or third-party outages

The platform is a tool. Its effectiveness depends on the user. Dead Hand makes no guarantee that use of the Service will result in any particular business outcome, revenue level, or lead conversion rate.

Payment and Billing

Subscriptions are billed monthly or annually in advance. Payments are processed by Stripe. All fees are non-refundable except as required by applicable law. We reserve the right to change pricing with 30 days' written notice to active subscribers.

Your account may be suspended if payment fails and is not resolved within 7 days of the due date. We will make reasonable attempts to notify you before suspension.

Suspension and Termination

We reserve the right to suspend or terminate any account that violates these terms, engages in abusive SMS practices, generates carrier complaints, or poses a risk to the platform or other tenants. In cases of clear abuse, suspension may occur without prior notice.

You may cancel your subscription at any time. Upon cancellation, your access will continue through the end of the current billing period. Your data will be retained for 90 days and then permanently deleted.

Limitation of Liability

The Service is provided "as is" without warranties of any kind. Dead Hand makes no representations that the Service will capture every inbound call, prevent every missed lead, or perform without interruption. Call routing, voicemail delivery, transcription accuracy, and AI triage are dependent on third-party infrastructure and are not guaranteed to be error-free.

Dead Hand is not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including lost revenue, missed leads, failed customer relationships, regulatory penalties, or business outcomes of any kind. This limitation applies regardless of whether the cause is platform error, user error, or circumstances outside either party's control.

Our total liability to you for any claim arising from use of the Service shall not exceed the amount you paid in the 30 days preceding the claim.

Indemnification

You agree to indemnify and hold harmless Dead Hand and its operators from any claims, damages, or expenses arising from your use of the Service, your violation of these terms, your violation of any applicable law including telecommunications regulations, or your failure to respond to leads captured by the platform.

Governing Law

These terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Lancaster County, Pennsylvania.

Changes to These Terms

We may update these terms as the Service evolves. Material changes will be communicated by email. Continued use of the Service after notification constitutes acceptance of the updated terms.
